WHEREAS, The Student Assembly has offered bus rides to area airports for Thanksgiving break for the last several years.
WHEREAS, The Thanksgiving Holiday is one of the busiest travel periods of the year which only complicates an already short break.
WHEREAS, This service was used by over 100 students to go back home and come back to campus over Fall Break of this year and provided this service in an affordable and practical manner.
WHEREAS, Using shuttle buses with multiple scheduled departures will accommodate the most number of students and ease the logistical implementation of this service.
Now, therefore, be it
RESOLVED, that the Student Assembly of the College of William and Mary-
- Allocates up to $4500 from the Consolidated Reserve Fund to pay Oleta Coach Lines to provide two buses on Wednesday, November 24th and Sunday, November 28th. One bus will go to Richmond International Airport, the other to Newport News Williamsburg International Airport and then Norfolk International Airport. Each bus will make approximately three runs from the Sadler Center to and from their respective airports over the course of the day.
- Charges the sponsors of this bill and the Executive Student Life Department with the implementation and promotion of this service.

WHEREAS, the Review Board and its members occupied a special position within the Student Assembly and should and must remain neutral.
WHEREAS, the Review Board members may be asked to judge the constitutionality of a bill, and comments for or against a bill would prejudice their judgment before the arguments have been made.
WHEREAS, every student has the right to bring an argument before the Review Board and have the Review Board listen to both side’s argument before making up its mind as to a decision.
WHEREAS, the Vice President is the presiding officer and decides the application of procedure at Student Senate meetings.
Now, therefore, be it
RESOLVED, that the Student Assembly of the College of William and Mary –
(1) Add the following bolded text to the code of the Student Assembly.
§2.1-1. Meetings of the Senate
6. Members of the Review Board may not speak on the Code, Constitution, or how a bill or initiative would relate to the Code or Constitution at a Student Senate meeting unless they are announcing a formal decision of the Review Board or the Chair of the Senate or President of the Student Assembly has formally requested an advisory opinion from the Review Board as a body. This includes making points of information, points of procedure, and all public comment.

WHEREAS, the Student Activities Reserves, formerly named the Consolidated Reserve, is currently at a substantial sum in excess of 80,000 dollars;
WHEREAS, cooperation between students and the City of Williamsburg is important to promote;
WHEREAS, Harry Potter is a big deal to the students at William & Mary and for the economy of Williamsburg;
WHEREAS, late night trolley sandwich would be emblematic of student-city cooperation.
Now, therefore, be it
RESOLVED, that the Student Assembly of the College of William and Mary –
(1) Funds $250 to the Williamsburg Area Transport Authority (WATA) to run the trolley service through 3am Friday the 19th of November
(2) Charges the sponsor of this bill with promoting the trolley service on this evening with a facebook event.
(3) Encourages President Scott to send out a campus-wide email also promoting the trolley service on this evening

WHEREAS, many student organizations and individuals have found the need to use the Freedom of Information Act to seek information from the college administration.
WHEREAS, often seeking this information is costly beyond the means of these organizations and individual students
WHEREAS, Students need to be able to conduct these necessary fact finding operations
Now, therefore, be it
RESOLVED, that the Student Assembly of the College of William and Mary –
- Creates a “FOIA Fund” earmarked from the Student Activities Reserve in the amount of $10,000 to be used for the filing of FOIA requests by student organizations or members of the student body to obtain information from College administrators.
- Mandates that access to this fund shall be controlled by an initial recommendation from the Senate Policy Committee, and shall be determined on a case by case basis.
- Further mandates the Senate Policy Committee’s recommendation shall then be considered by the Senate Finance Committee, and approved on a case by case basis. In the event of the Finance Committee’s approval, the cost of the FOIA request shall be covered fully or partially subsidized by the Fund.
- Charges the sponsors of this bill with exploring the creation of a database of information obtained from FOIA requests subsidized through this fund for use by other student organizations and individuals.
SB 318-049: The Endowment Act

WHEREAS, the Student Activities Reserves, formally named the Consolidated Reserve, is currently at or around $81,444, which does not include any potentially returned money from the recently funded Charter Day concert.
WHEREAS, the Student Activities Reserves have traditionally held close to or over a hundred thousand dollars.
WHEREAS, every year tens of thousands of dollars are added to the Student Activities Reserves.
WHEREAS, it would be irresponsible to continue with a system that could allow literally hundreds of thousands of dollars of student money sit unused in an account.
WHEREAS, a cap effective at the end of each year would allow excess money to be spent to better all past, present, and future students.
WHEREAS, a cap of sufficient height would both give the Student Assembly the requisite resources to continue to pursue the students’ goals and influence responsible future spending.
Now, therefore, be it
RESOLVED, that the Student Assembly of the College of William and Mary –
(1) The following bolded language be added to the Code of the Student Assembly.
§3.3-5.5. Consolidated Reserve Fund
1. The Department of Finance shall be charged with estimating revenues generated by the Student Activities fund, and any monies that are appropriated through the budget process and not used, shall be placed in a fund named the Consolidated Reserve Fund. At the end of the academic year, before any monies that are appropriated through the budget process and not used are placed in the Consolidated Reserve Fund, any monies in the Consolidated Reserve Fund in excess of $100,000 shall be given to the Fund for William and Mary to be endowed to generate interest for the College in perpetuity. Consolidated Reserve fund may be used for emergency funding or special projects that the Student Assembly deems beneficial to the campus as whole.

WHEREAS, the SA Constitution defines the number of senators who must vote to take an action, either a majority, 2/3rds, or 3/4ths, in every case except the Senate’s confirmation of Presidential appointments.
WHEREAS, traditionally 2/3rds votes have been used to confirm appointments by the Senate.
WHEREAS, we should not have a document that is unclear, especially in so integral a part of its function.
Now, therefore, be it
RESOLVED, that the Student Assembly of the College of William and Mary –
(1) Amend the SA Constitution to replace the word “consent” with the bolded words in the following Constitutional language.
Section III: Powers of the President
III. To appoint, with the advice and 2/3rds vote of Senate, the Secretaries of the Executive Departments and principle officers of Agencies and Offices, who may appoint the necessary assistants and deputy officers to assist in the execution of their duties;
ARTICLE III: JUDICIAL BRANCH
Section I: Creation of the Review Board
I. The judicial powers of the Student Assembly shall be vested in a single Review Board. The Review Board shall be composed of six Board Members and one Chairman. The Board shall meet only when a case has been brought for review.
II. The President shall appoint all members of the Review Board with the 2/3rds vote of the Senate. He must make all such appointments before the second Tuesday of September following his inauguration. If a vacancy shall occur, he must make such appointment within fourteen academic days. Board Members shall serve for a period of one year. The Senate may, by vote of simple majority, and with the consent of the President, keep a member of the Board in the Office beyond one year.

WHEREAS, section §3.3-6 (i.e., the Executive Spending Limitation section) expires on October 26th, 2010;
WHEREAS, this section of the Finance Code must be renewed to allow the Student Assembly to continue to function; and
WHEREAS, it is in the best interest of the Student Assembly and the student body as a whole that the Finance Code be brought up to date to reflect current accepted procedure;
Now, therefore, be it
RESOLVED, that the Student Assembly of the College of William and Mary –
- Hereby amends section §3.3-6 of the Code of the Student Assembly to read as follows:
§3.3-6. Executive Spending Limitation
§3.3-6.1. Executive Limitations
- The Student Assembly shall maintain an account, located at SunTrust Bank (herein known as the “Primary Off-Campus Account”). This account shall only be spent from via a Senate bill, authorized in advance by the normal process of legislation, or via the provisions in this section.
- This account shall receive all profits from Student Assembly activities outside the fundraising activities of the individual social classes, graduate school associations, and the Undergraduate and Graduate Councils. Such Student Assembly activities shall include, but not be limited to, the refrigerator and microwave sales.
- The sum total of all Executive expenditures on this account, passed through the provisions in this section, shall not exceed $750 per month. This total may be exceeded only through advance passage of a separate Senate bill.
- Any additional off-campus accounts, held by the Student Assembly, beyond the Primary Off-Campus Account (herein known as “Secondary Off-Campus Accounts”) shall require the advance passage of a Senate bill to either create these accounts and/or initiate transactions within them. All restrictions relevant to the Primary Off-Campus Account herein shall also apply to the Secondary Off-Campus Accounts, unless otherwise specified in section §3.3-6.
- All changes within any Student Assembly account altering the liquidity of any of the funds, requires require the advance passage of a Senate bill.
- In addition, as a special exception to part 3 of this subsection, the Student Assembly President shall be allowed to temporarily advance money to a registered student organization in good standing, defined as having no outstanding debts to the office of Student Activities, provided that the expense has already been approved through the normal budget or special events funding process. This money must be repaid within 14 days. After this time, the Student Organization will be subject, but not limited; to freezing all future funds until the matter is resolved.
7. Further, the Student Assembly President shall be allowed to spend up to $10,000 from the Consolidated Reserve during the summer session, defined as the time between the last senate meeting of academic year to the first meeting of the next academic year. All restrictions in sections §3.3-6.2 apply.
§3.3-6.2. Account Regulations
- The off-campus account(s) shall be required to have two signatories on the account to include the President of the Student Assembly and the Secretary of Finance. A signatory is someone who has filled out paperwork with the bank and whom the bank recognizes as having the ability to sign checks. It does not confer any other rights, specifically the right the authorize purchases.
- Every transaction made pursuant to this section (i.e. not separate Senate bills) over $200 must be proposed by the SA President and sent out over the Senate Finance Committee’s electronic mailing list at least 12 hours prior to the purchase. This written proposal must include approximate cost and purpose of the expenditures. Confirmation as well as Itemized Details surrounding any purchase over $200 must be sent out over the Senate Finance Committee’s electronic mailing list within 24 hours of the purchase. In the event of a campus emergency (ie e.g., a previously unplanned vigil) the 12-hour notification requirement is lifted.
- The Student Assembly shall use the monies collected in the off-campus account(s) for purposes that serve the betterment of the Student Body. Such things shall include:
- office supplies for SA business
- printing costs for SA business
- costs for SA events and initiatives, including awards and prizes for such initiatives
- T shirts or uniforms for campus activities and events
- dues for organizations of which the SA and/or the College is a member
- Freedom of Information Act requests
- website costs
- get out the vote efforts
- funding events, activities, and improvements for Student Organizations
- Greater Williamsburg community events
- any purposes allowed by the SA budgeting or special events processes, as outlined in the Finance Code
Such things shall never include:
- Salaries
- personal purchases for individuals except as otherwise defined in this section
- lending of money to an individual except as otherwise defined in this section
- purposes not allowed by local, state, or federal law
- The only method for allocating funds from any account is written checks, signed by one of the two signatories. These checks must be filled out entirely with their purpose in the memo or “for” line.
- The checks from all accounts must be secured by the SA President. If this checkbook is stolen or lost, the SA President shall immediately notify the Senate Finance Committee and shall immediately take all steps to reconcile the issue with the bank.
- Every purchase with a receipt shall be presented to the Secretary of Finance to aid in record keeping. The Secretary of Finance shall establish a location for these receipts to be kept. The Secretary of Finance may decide a process by which to submit these receipts.
- In order to ensure a smooth transition year to year, the outgoing Student Assembly President and Secretary of Finance shall be required to transfer signatory authority to incoming administration within five business days of the inauguration. If there is no new Secretary of Finance at this time, they shall transfer signatory authority to the incoming President of the Student Assembly. All financial records from the previous year shall be turned over to the incoming Student Assembly President within 5 business days of inauguration.
§3.3-6.3. Account Transparency and Reporting
- The balances and all activities in the Student Assembly off-campus account(s) must be available to the entire student body. The Secretary of Finance shall be required to make the account balances and the transactions public on the Student Assembly website, which will be updated monthly. This shall be done by uploading an updated Google spreadsheet link to the SA website. The website shall be consistent with the statements issued by the financial institution where such accounts are located and shall include the reasons for the authorization of each specific purchase, the amount spent, and the person/entity that received the funds.
- All monies in off-campus and reserve accounts, regardless of type, must be accounted for and reported monthly to the Senate by the Secretary of Finance or the President of the Student Assembly’s designee. Such reports shall be issued in person and by electronic mail to the Senate by the first Senate meeting of every month. Should the Secretary of Finance be unavailable to issue a report, the President of the Student Assembly shall be responsible for designating someone to complete the task. The President of the Student Assembly, in any case, is responsible for the completeness and accuracy of all reports. These reports shall demonstrate that the information on the website is consistent with the statements issued by the financial institution where such accounts are located and shall include the reasons for the authorization of each specific purchase, the amount spent, and the person/entity that received the funds.
- The Primary Off-Campus account All off-campus accounts shall have online banking. This online banking shall include the ability to view the copy of each scanned check. The following people shall have the ability to independently login and view all online information: President of the Student Assembly, Vice President of the Student Assembly, Secretary of Finance, Chairman of the Senate, and the Chair of the Senate Committee on Finance and Budget.
- Any Senator may request records from the off-campus account(s), including all banking and financial records from financial institutions, and including reasoning for authorization of specific purchases. Such requests shall be made to the Secretary of Finance, upon which the Secretary shall have seven business days to comply with the information request. Additionally, these records may be requested pursuant to the provisions of the Virginia Freedom of Information Act.
- The Senate Committee on Finance and Budget shall be responsible for oversight of all off campus accounts. The committee shall review the on-line records monthly following the meeting at which the Secretary of Finance presents his or her report to ensure that they are consistent with the executive’s report.
- If the Senate Finance Committee votes by a majority of its standing members, it may call the Student Assembly President, Vice President, Senate Chair, and/or Secretary of Finance to appear at one of its next two regularly scheduled meetings to answer questions pertaining to the off-campus accounts. The Student Assembly President, Vice President, Senate Chair and/or Secretary of Finance shall be in serious neglect of the duties of their office if they do not appear.
- Any elected official who misappropriates monies or withholds information from the Senate regarding their use will have a bill of impeachment brought against them by the Senate Committee on Finance and Budget to the Senate floor at the subsequent meeting, as described in the Constitution of the Student Assembly. Any non-elected official who misappropriates monies or withholds information from the Senate regarding their use will have a letter of concern drafted and delivered by the Senate Committee on Finance and Budget to the Student Assembly President concerning the non-elected officer’s inappropriate behavior, and if the behavior is not remedied within two weeks of delivery, the Chair of the Senate Committee on Finance and Budget will introduce a bill requiring impeachment of the Student Assembly President if the behavior of the non-elected official is not remedied by the next Senate meeting.
- If applicable, the person shall also be referred to the William and Mary Honor Council by the Chair of the Senate Committee on Finance and Budget or the Chair of the Senate.
§3.3-6.4. Expiration
The above direction (ie §3.3- 6 –ie the Off Campus Account Section) expires on October 27TH, 2011.
